These Terms of Service govern your use of aquaeuro.mt and purchases made through the website.

The website is operated by AquaEuro Water Treatment Limited, a company registered in Malta and trading as AquaEuro Malta.

Throughout these Terms, “AquaEuro”, “AquaEuro Malta”, “we”, “us” and “our” refer to AquaEuro Water Treatment Limited.

By using this website or placing an order with us, you agree to these Terms of Service. Nothing in these Terms affects any statutory rights you have as a consumer under Maltese or European Union law.

1. About AquaEuro Malta

AquaEuro Malta supplies water treatment equipment including water filters, reverse osmosis systems, water softeners, replacement filters, fittings, accessories and related products.

2. Using Our Website

You may use this website for lawful purposes and to browse, obtain information about and purchase AquaEuro products and services.

You must not:

  • Attempt to gain unauthorised access to our website, systems or customer information

3. Product Information

We make reasonable efforts to ensure that product descriptions, photographs, specifications, dimensions, prices and other information displayed on aquaeuro.mt are accurate.

Water treatment products can vary in performance depending on factors including:

  • Water pressure and flow rate
  • Water hardness

  • Replacement of consumable filters or media

Product capacities, filter life, flow rates and performance figures should therefore be considered in conjunction with the conditions stated on the relevant product page.

Where a filtration product is stated to reduce a particular substance, the level of reduction may depend on the incoming water quality, usage and operating conditions.

Unless specifically stated otherwise, water treatment equipment sold by AquaEuro should not be relied upon to make a microbiologically unsafe or otherwise unsuitable water supply safe for drinking.

If you intend to use a product on a borehole, well, rainwater system, private water supply or any source other than the municipal mains water supply, please contact us before ordering so that we can advise on suitability or arrange a water test.

4. Choosing the Correct Product

We are happy to provide guidance to help customers select appropriate water treatment equipment.

Where we make a recommendation based on information supplied by you, it is important that the information you provide about your property, plumbing, water supply, household size and requirements is accurate.

If you are unsure whether a product is suitable, please contact us before placing your order.

Nothing in this section affects your statutory rights where a product does not conform to the contract or is not fit for a particular purpose that was made known to us and accepted by us.

5. Orders

Placing an order through aquaeuro.mt constitutes an offer to purchase the products in your order.

After placing your order, you will receive an electronic acknowledgement confirming that we have received it.

We may decline or cancel an order before it has been accepted where, for example:

  • A product is unavailable
  • Payment cannot be authorised
  • Delivery cannot reasonably be made to the supplied address
  • There is an obvious pricing or product-information error
  • We reasonably suspect fraudulent activity

If we cancel an order after payment has been taken, any amount paid for the cancelled products will be refunded.

We may contact you if further information is required before an order can be processed.

6. Prices and Payment

Prices are displayed in euros (€).

Prices shown on the website include VAT where applicable unless clearly stated otherwise.

Delivery, installation or other additional charges will be agreed with us directly before you become liable to pay them.

Payment must be made using one of the payment methods made available during checkout.

We take reasonable care to ensure prices are correct. If an obvious pricing error is identified after an order has been submitted, we will contact you and give you the option of proceeding at the correct price or cancelling the affected product for a full refund.

7. Availability

Products are subject to availability.

Stock information displayed on the website is intended to be kept current but may occasionally be inaccurate due to simultaneous orders, stock discrepancies or other circumstances.

If a product becomes unavailable after you place an order, we will contact you and offer an appropriate solution, such as waiting for new stock, selecting an alternative product or receiving a refund for the unavailable item.

8. Delivery

We deliver to the locations made available through our website and checkout.

Any delivery times provided are estimates unless a specific delivery date has expressly been agreed.

We will make reasonable efforts to deliver within the stated timeframe and will contact you if there is a significant delay.

Please ensure that the delivery address and contact information supplied with your order are accurate.

For consumer orders, responsibility for the goods normally passes to you when you, or a third party nominated by you other than the carrier, takes physical possession of them.

Please inspect your order when it arrives and contact us promptly if it appears to have been damaged during transport or if anything is missing.

9. Your 14-Day Right to Cancel

Consumers purchasing eligible goods online generally have the right to withdraw from their purchase within 14 days of receiving the goods, without providing a reason.

To exercise this right, you must clearly notify us within the 14-day period.

After notifying us of your decision to cancel, the goods should normally be returned within a further 14 days.

For change-of-mind returns, you are responsible for the direct cost of returning the goods unless we have agreed otherwise.

For large or heavy products such as water softeners or whole-house filtration equipment, please contact us before arranging a return.

10. Handling Returned Products

Consumers may inspect goods to establish their nature, characteristics and functioning.

If goods have been handled beyond what is reasonably necessary for this purpose, we may make an appropriate deduction from the refund for any resulting reduction in value where permitted by law.

With water treatment equipment, installation or use can substantially affect the condition and resale value of a product.

This may include:

  • Connecting the equipment to a water supply
  • Passing water through a filtration system
  • Using filter media or cartridges
  • Filling or commissioning a water softener
  • Modifying components or pipework
  • Otherwise putting the product into normal service

This does not remove or restrict your statutory rights and does not prevent you from making a claim where goods are faulty or do not conform to the contract.

11. Faulty or Non-Conforming Products

Your statutory rights relating to faulty or non-conforming goods are separate from your 14-day right to change your mind.

Goods supplied to consumers must conform to the contract and meet the requirements imposed by applicable Maltese consumer law.

If a product is defective, damaged, not as described or otherwise fails to conform to the contract, please contact us.

Depending on the circumstances and applicable law, you may be entitled to remedies such as:

  • Repair
  • Replacement
  • A reduction in price
  • A refund

Please provide proof of purchase and, where practical, photographs or video showing the issue. This helps us diagnose faults and resolve problems more quickly.

Nothing in these Terms limits the legal guarantee or other mandatory consumer rights available under Maltese law.

12. AquaEuro Product Warranties

Certain AquaEuro products are supplied with an additional commercial warranty or guarantee.

The duration and conditions of any commercial warranty are stated on the relevant product page, warranty documentation or other information supplied with the product.

For example, some AquaEuro water softeners may carry longer commercial warranties than the minimum protection provided by law.

A commercial warranty is additional to, and does not replace or reduce, your statutory consumer rights.

Where maintenance, servicing, installation or other conditions apply to a particular commercial warranty, these will be set out in the relevant warranty terms.

13. Installation

Some AquaEuro products are designed for straightforward installation, while others should be installed by a suitably competent person or qualified plumber.

You should follow the installation and operating instructions supplied with the product.

Before installation, the installer should check that the product is suitable for the:

  • Water supply
  • Water pressure
  • Pipe size
  • Flow requirements
  • Available installation space
  • Drainage requirements, where applicable
  • Electrical supply, where applicable

Where installation is supplied or arranged as part of your contract with AquaEuro, the applicable service arrangements will be confirmed separately.

If you choose to use an independent installer, the installer is responsible for carrying out their work correctly.

Nothing in these Terms affects any consumer rights that may arise where incorrect installation results from installation carried out as part of our contract or from inadequate installation instructions supplied with the goods.

14. Filter and Consumable Replacement

Some AquaEuro products require periodic replacement of filters, cartridges, membranes, salt or other consumable materials.

Published replacement intervals are normally based on expected or typical use and may vary according to water quality and consumption.

Customers are responsible for following the maintenance schedule applicable to their system.

Failure to maintain a water treatment system can reduce its performance and may affect the lifespan of consumable components.

15. Malta Tap Water Scheme and Other Grants

From time to time, certain AquaEuro products may be eligible for government or regulatory grants, reimbursements or incentive schemes, including schemes administered by the Regulator for Energy and Water Services (REWS).

Any information provided by AquaEuro concerning such schemes is provided to assist customers.

Unless expressly stated otherwise:

  • AquaEuro does not administer the scheme
  • Eligibility is determined by the relevant authority
  • Approval is not guaranteed
  • Scheme rules and availability may change
  • The customer is responsible for making the relevant application and providing the required documentation

AquaEuro is not responsible for a grant or reimbursement being refused where the decision is made by the relevant government or regulatory authority.

This does not affect our responsibility to provide accurate information about the product purchased or any documents we have agreed to provide.

16. Promotions and Discount Codes

From time to time we may offer promotional prices, discount codes or other offers.

Unless otherwise stated:

  • Promotions cannot normally be combined
  • Offers may be limited to specified products or dates
  • Discount codes must be entered before completing checkout
  • Promotions have no cash value

Any conditions specific to a promotion will be stated with the offer.

Nothing relating to a promotional or sale price affects a consumer's statutory rights where goods are faulty or do not conform to the contract.

17. Website Accuracy and Availability

We aim to keep aquaeuro.mt accurate and available, but we cannot guarantee that the website will always operate without interruption or technical error.

We may update, correct or change website content where reasonably necessary.

Any change to website information does not retrospectively remove contractual or statutory rights relating to an order we have already accepted.

18. Intellectual Property

Unless otherwise stated, the content of aquaeuro.mt, including text, graphics, photographs, videos, branding, logos, product information and website design, belongs to AquaEuro Water Treatment Limited, another company within the AquaEuro group, or the relevant rights holder.

Website content may be viewed and used for personal, non-commercial purposes.

You may not reproduce, distribute, republish, commercially exploit or modify our content without permission unless permitted by law.

19. Third-Party Services and Links

Our website may contain links to or integrations with third-party websites and services, including payment providers, delivery services, social media platforms and government or regulatory websites.

Those third parties may operate under their own terms and privacy policies.

AquaEuro is not responsible for the content or operation of independent third-party websites.

This does not affect our responsibilities as the seller for purchases made from AquaEuro.

20. Personal Information

Personal information provided through aquaeuro.mt is handled in accordance with our Privacy Policy and applicable data-protection law.

21. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

In particular, nothing in these Terms limits or excludes:

  • Your statutory consumer rights
  • Liability for fraud or fraudulent misrepresentation
  • Liability for death or personal injury where it cannot lawfully be excluded
  • Any other liability that cannot legally be limited or excluded

AquaEuro is not responsible for losses that were not reasonably foreseeable when the contract was entered into or for losses caused by circumstances outside our reasonable control, except where applicable law provides otherwise.

Where products are purchased wholly or mainly for personal use, AquaEuro will not seek to exclude liability that consumers are legally entitled to recover.

Customers must use and maintain products in accordance with their instructions and intended purpose.

22. Events Outside Our Reasonable Control

We will not be responsible for delays or failures caused by circumstances outside our reasonable control, such as severe weather, transport disruption, strikes, interruption to utilities, natural disasters, government action or significant disruption to suppliers.

Where such an event materially affects an order, we will take reasonable steps to contact you and minimise the impact.

Your statutory rights, including any right to cancel where applicable, remain unaffected.

23. Severability

If any part of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply.

24. No Waiver

If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.

25. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, website or applicable law.

The version applicable to your purchase will normally be the version in effect when your order was placed.

Material changes will not retrospectively reduce rights relating to contracts already entered into.

These Terms and contracts entered into through aquaeuro.mt are governed by the laws of Malta.

Nothing in this section deprives a consumer of any mandatory protection or right to bring proceedings before a court or tribunal that applies under Maltese or European Union law.
